ARTICLE 1 – PROPOSAL AND ACCEPTANCE
1.1. The written acceptance of the order by the customer or the commencement of the execution of the order by the customer will constitute acceptance of the order and these Terms and Conditions of Purchase.
1.2. By concluding the Purchase Contracts, according to procedure, the Customer accepts and undertakes to observe these General Terms and Conditions. The Customer, therefore, is invited to read carefully, before making any purchase transaction, these General Terms and Conditions and, once the purchase procedure provided by the Site has been completed, to print them out or otherwise retain them, as preferred. Mariet Beauty may change, at any time and without notice, the content of the General Conditions, the General Conditions published on the Site at the time the Customer sends the purchase order itself will apply to the Purchase Agreements.
1.3 Orders will be cancelled on the fifth day after receipt of the same, if the customer has not made payment according to the chosen method and has promptly notified the hindering causes.
1.4 Orders may be canceled at the customer’s request, but only if it has not yet been shipped. Conversely, orders already entrusted to the courier may not be cancelled, but may be subject to return once delivered, according to the directions set forth in these terms of sale.
ARTICLE 2 – MINIMUM ORDER
2.1. There is currently no minimum order requirement.
ARTICLE 3 – OBLIGATIONS AND PERFORMANCE
3.1. The Customer shall execute the order in accordance with these General Terms and Conditions of Purchase. Customer shall provide all information that from time to time Mariet Beauty shop requires in connection with the Orders and shall also promptly notify if, at any time, Customer is prevented or delayed or becomes aware of any circumstance that may place Customer in a position of being prevented or delayed from executing any portion of its Order.
3.2. It is possible that there may be occasional non-availability of the Products offered, in which case, if the Products chosen by the Customer are, in whole or in part, not available, the same will be replaced with others agreed in advance with the customer or the order will be sent with the available products after sending notice to the Customer about the unavailable products making a refund for the missing part.
3.3. Mariet Beauty shop reserves the right to vary the Order at any time. Any such variation will be accomplished by a written revision of the Order, accepted in the manner set forth in Article 3.1 above.
3.4. Mariet Beauty shop reserves the right to cancel an order, if the order includes the surcharge on the ordinary shipping rate, for inconvenient locations, not previously entered by the automatic system for calculating shipping rates. These locations are listed and visible on our courier company Poste Italiane’s website.
ARTICLE 4.1 – PRODUCTS
4.1. All Products offered are detailed on the home page of the Site, within their respective sections, separated by Product categories. The visual representation of the Products on the Site, where available, normally corresponds to the photographic image of the Products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment, on the part of Mariet Beauty shop, regarding the exact correspondence of the image depicted on the Site with the actual Product; and this, with particular regard to its actual dimensions and/or the chromatic aspects of the Products and/or packaging. In case of any difference between the picture and the written product sheet, the product sheet description always prevails.
ARTICLE 4.2 – DAMAGED, BROKEN PRODUCT, TAMPERED PACKAGE.
4bis.1. All of our products are carefully packed in order to avoid and/or reduce accidents and damage during transportation.
However, it may happen that you receive the package with the carton wet and/or damaged, broken, tampered with or with non-personalized adhesive film from our store. In such cases, it is advisable to accept the package with reservation by affixing the words “open neck” – “wet neck” – “taped neck” etc., or not to accept it, in order to initiate a dispute with the courier company. By accepting the package without reservation, the customer assumes responsibility for the integrity of the contents without making any claim to Mariet Beauty shop for reimbursement.
If you still receive the package or if it was intact but inside one or more products were damaged or broken, we ask that you immediately (check the package immediately after delivery by the courier or within the day) send an email attaching a photo of both the damaged/broken product, inside the package, the packaging (wet or damaged) and the carton of the box. The photo is essential both to consider a possible refund in the form of a voucher or the return of the product, and to send a claim to the courier by us for the damage done. Refund claims will not be accepted in cases of emails sent with photos of products not in the packaging or package, or sent more than 3 days after delivery.
During the shipment of goods, the risk of loss of or damage to the goods, due to causes not attributable to the seller, is transferred to the consumer only at the time when the latter, or a third party designated by him and other than the carrier, takes physical possession of the goods.
While the risk is transferred to the consumer already at the time of delivery of the goods to the carrier if the latter has been chosen by the consumer and this choice has not been proposed by the trader, without prejudice to the consumer’s rights against the carrier.
ARTICLE 4.3 – MISSING PRODUCT.
If an incomplete order is received, i.e., with one or more products missing as per the receipt inside the package, the customer must contact us to report the incident, within the terms set forth below. The report must be sent within 8 (EIGHT) days after the order has been delivered. No reports for missing products will be considered after this period has passed.
ARTICLE 4.4 – WRONG PRODUCT
4ter.1. If you receive the wrong product, mistakenly sent from our warehouse, simply send us an email attaching a photo of the product you received and we will refund or send back the correct product at no charge to the customer, or if you prefer, you can opt for a voucher equal to the value of the product. In any case, we apologize if such unpleasantness occurs.
ARTICLE 5 – WARRANTY
- The seller is liable to the consumer for any lack of conformity existing at the time of delivery of the goods.
- In the event of a lack of conformity, the consumer has the right to the restoration, without cost, of the conformity of the goods by repair or replacement, in accordance with paragraphs 3, 4, 5 and 6 (Consumer Code), or to an appropriate reduction in the price or termination of the contract, in accordance with paragraphs 7, 8 and 9 of the Consumer Code
Mariet Beauty shop does not offer any additional warranties beyond those provided by individual manufacturers; except in cases of fault or intent on the part of Mariet Beauty shop, for which it is liable to an extent not exceeding the price/cost of the product purchased by the customer and subject to dispute.
ARTICLE 6 – TRANSPORTATION: PRICES, ARRANGEMENTS AND DELIVERY
5.1. Orders will be delivered to the address specified in the order. The cost of shipping is set at 6.90 euros for amounts up to 119.00 euros, FREE for amounts of 120 euros or more (all Italy). For locations with Peripheral ZIP codes there is a surcharge of €2.00, for Disadvantaged ZIP codes there is a surcharge of shipping costs, about 13 euros, for this reason Mariet Beauty shop reserves the right to change the prices of shipping in relation to orders that provide for the destination locations indicated in the section of the site of the express courier (locations and costs viewable on the site www.posteitaliane.it), or to cancel the order upon refusal by the customer to pay these costs.
5.2. The order is entrusted to the courier in 1/2 working days (24/48 hours) from the receipt of the order, while delivery will be made within 1-2 working days (24/48 hours) from the shipment of the order for Italy, while for Islands and Calabria delivery takes place in 2/3 working days (48/12 hours), as established by the courier regarding the timing. The customer will be notified of the shipment by email. Delivery will be deemed to have taken place when the courier has delivered the goods (in terms of description, quality, and quantity) to the address arranged in the order. The Order shall be considered concluded when all products have been delivered in accordance with the provisions of these general conditions and accepted by the Buyer. Upon delivery of the Products by the courier company appointed by Mariet Beauty shop, the Customer is required to check thoroughly:
- (a) That the anti-abrasion label is intact and the packaging is undamaged or otherwise altered
- (b) That the number of pieces being delivered corresponds to what is indicated in the transport document.
Any damage to the anti-abrasion label, packaging and products or mismatch in the number of pieces/packages or indications must be immediately contested by the Customer, who may contact Mariet Beauty shop through the Contacts specifying the order for which such misunderstandings occurred. Cases of force majeure, unavailability of means of transportation, as well as unforeseeable or unavoidable events that cause a delay in deliveries or make deliveries difficult or impossible or cause a significant increase in the cost of delivery to be borne by Mariet Beauty Shop, shall entitle it to split, postpone or cancel, in whole or in part, the scheduled delivery or to terminate the Purchase Agreement. In such cases, it will be Mariet Beauty Shop’s responsibility to provide timely and adequate notice of its determinations to the e-mail address indicated by the Customer and the latter will be entitled to a refund of any price already paid, excluding any further claim, for any reason whatsoever, against Mariet Beauty Shop.
ARTICLE 7 – METHOD OF PAYMENT
6.1. Payment for purchased Products is made by PayPal, Klarna or Credit Card, as specified by individual payment processors.
ARTICLE 8 – WITHDRAWAL RIGHTS
7.1. Purchases made on the Site (marietbeauty.com) are governed by these General Terms and Conditions as well as by the Italian law on mail order/distance sales. Pursuant to Legislative Decree. 206/2005 (Consumer Code), the Consumer Customer (i.e., a natural person who purchases goods for purposes not related to his or her professional activity, i.e., without indicating a VAT No. reference) has the right to withdraw from the purchase contract for any reason and without explanation, within the period of 14 working days, under the conditions set out below.
To exercise this right of withdrawal, the Customer must send a notice to that effect, by registered letter r/r, within 14 (fourteen) working days from the date of receipt of the goods. Returns must be made with shipping paid by the Customer. Substantial integrity of the property to be returned is an essential condition for the exercise of the right of withdrawal. However, it is sufficient that the property be returned in normal condition, as it was at the time of delivery. Once the integrity of the returned Product has been verified Mariet Beauty Shop will refund the Customer the full amount paid for the Products, referred to in the Purchase Agreement subject to withdrawal, no later than 14 (fourteen) days from the informed decision and in any case after the return of the Products themselves, by payment method used for the original transaction. If the Customer opts for a different and more onerous method, Mariet Beauty Shop has the right to claim the surcharge due or deduct it from the refund amount.
It should be noted that in accordance with the relevant regulations, Mariet Beauty Shop will refund to the Customer the sums paid by the latter as the price of the Products. It will remain the responsibility of the Customer to pay the costs necessary to return to Mariet Beauty Shop the Products subject to withdrawal by courier chosen by him.

ARTICLE 9 – PROCESSING OF PESONAL DATA
8.1 Customers’ data are processed by Mariet Beauty Shop in accordance with the provisions of the current legislation on the protection of personal data, as specified in the information in the specially dedicated section called “Privacy Policy””.
ARTICLE 10 – DISPUTES
In case of disputes, the customer or anyone who endorses disputes against Mariet Beauty Shop, the place of jurisdiction is BARI.
